WEDDING VIDEOGRAPHY SERVICES AGREEMENT

 

This Videography Services Agreement ("Agreement") is made on [Your wedding date], between Forever Yours Films, of Cleary TV Ltd. 39 Bristow Road, Croydon, Greater London CR0 4QQ. Thereinafter referred to as the "Videographer", and [Client's Full Name, Address, Phone Number], hereinafter referred to as the "Client".

 

  1. SCOPE OF SERVICES

    1. The Videographer agrees to provide wedding Videography services on [Date of Wedding] at [Wedding Venue/Location]. The services will consist of capturing candid, and posed filmed shots as previously agreed, spanning a duration of [specific duration], facilitated by 1-2 videographers.

    2. Additional services or hours beyond the aforementioned scope will be subject to an additional fee of £200 per additional filming hour.

 

  1. PRE-WEDDING CONSULTATION

    1. A pre-wedding consultation will be organised by phone 7-14 days before the wedding date to review and agree upon the Client's specific requirements and runner order of the day.

 

  1. PAYMENT AND FEE STRUCTURE

    1. To secure the specified date, a non-refundable 20% deposit is required. This deposit is an acknowledgement of the videographer's commitment and potential loss of other opportunities.

    2. The pre wedding balance (40%) , is payable 30 days before the wedding date.

    3. The post wedding balance (40%) is payable 12 weeks after the wedding date.

    4. Payments can be made via Stripe, a secure payment system. Late payments may incur a charge.

 

  1. WEDDING DAY

4.1 Cooperation: The Clients and the Videographer consent to happily cooperating and communicating with each other to achieve the best possible result within the understanding of this contract. I would recommend that the Videographer would be provided with a helper (Maid of Honour or Best Man) who will point out key individuals and assist in organizing family groups. The Clients also agree to give the Videographer sufficient warning of key events at the wedding to give the Videographer time to prepare, e.g. Bouquet throwing, cutting the cake, speeches etc. Please note that not all guests at weddings like having their photo taken. In such cases, the Videographer will use her/his discretion but cannot be held responsible for lack of photos of these people.

4.2. The Schedule: Our shooting schedule, style of working and experience are designed to achieve a documentary, cinematic style of wedding videography for the Clients, accomplished with good humour and enjoyed by all concerned. Both the Clients and the Videographer, therefore, agree that punctuality and cheerful cooperation are essential to producing outstanding film results. In cases where the wedding does not run on time (for example, extreme lateness by one of the Clients arriving to the church) we cannot guarantee to take our normal sequence of filming although in such circumstances we will do our absolute best to compensate.

4.3. Paparazzi Wedding Guests: All your guests will have digital cameras/phones, and all your guests will want to photograph the Clients. In the spirit of cheerful cooperation, the Clients agree to give the Videographer and Photographer’s precedence over the guests in order to take the video shots required for the wedding services described above. We cannot be held liable for lack of wedding photos if guests taking their own photos of the Clients continually interrupt the Videographers work.

4.4. House Rules: Note the Videographers are sometimes limited by rules imposed by registrars, ministers and venue management as to what can and cannot be done. For example, some ministers insist that only one camera is allowed at the alter and others will insist that the Videographer shoot from a specific location or refuse to wear a microphone. In such circumstances, the Clients agree to accept the technical limitations that may be imposed on the equipment used. I advise the Clients to make themselves aware of the rules of the venue concerned and if necessary, negotiate with the personnel concerned.

  1. DELIVERABLES

    1. The videographer commits to delivering at least 3 film chapters of the day plus highlights which will be professionally edited and colour graded. Films  will be delivered without watermarks.

    2. Delivery will be within 12 weeks of the wedding via a personalised Vidflow Gallery or other download link. In busy times there may be an additional delay in delivery but the Client will be kept informed if this is likely to happen.

    3. Additional requests, including physical copies, further edits, or alternative formats, may be subject to additional fees.

  1. ARTISTIC DISCRETION

    1. The videographer retains the discretion in choosing the clips provided to the Client. Not every clip taken will be included in the final deliverable.

  1. EXCLUSIVITY

    1. The videographer will be the exclusive professional videographer hired for the purpose of filming the wedding. Conflicts with this exclusivity can compromise the quality of the films.

  1. COPYRIGHT AND USAGE RIGHTS

    1. Copyright of the films remains with the videographer under the UK Copyright, Designs, and Patents Act 1988. The Client is granted a personal use license. This permits sharing with friends, family, and personal social media.

    2. Commercial use, editing, sale, or unauthorised distribution requires express written consent from the videographer.

    3. The Videographer may also post photos/videos from your wedding in a variety of places, which is done for legitimate interest. Should you or any member of your wedding party not wish to be included in this, please let me know by email. This may include but not limited to Forever Yours website, In wedding blog features, On social media, To your other wedding suppliers

  1. SAFE WORKING ENVIRONMENT

    1. The Client will ensure the videographer is provided a safe environment and that guests cooperate during the wedding day.

  1. CANCELLATION, RESCHEDULING, AND FAILURE TO PERFORM

    1. If the Client cancels or reschedules the wedding within 60 days of the wedding, a fee of £200 will be charged. The deposit remains non-refundable.

    2. If the videographer cannot perform due to unforeseen circumstances, such as illness or equipment malfunction, a full refund will be given, or a replacement videographer of similar expertise may be provided with the Client's consent.

  1. VENUE GUIDELINES

    1. The Client will secure any necessary permissions from the venue for filming activities and will apprise the videographer of any venue-specific guidelines or restrictions, i.e confirming with churches filming is permitted and checking drones are permitted.

  1. MEALS AND BREAKS

    1. For wedding coverage exceeding 6 hours, the Client agrees to provide a hot meal and suitable breaks for the videographer and their team. Venue/caterers will usually be happy to provide a subsidised 1 course supplier meal.

  1. TRAVEL AND OVERAGE FEES

    1. Travel outside of a 50 mile radius from the videographer's base location may incur extra costs. Overage fees are outlined in section 1.2.

  1. LIMITATION OF LIABILITY

    1. The videographer's liability for any failure to deliver services is restricted to the return of all payments received.

  1. INDEMNIFICATION

    1. The Client agrees to indemnify the videographer against any claims or damages resulting from the Client's negligence or failure to adhere to any agreement terms.

    2. Your security is very important to me and the Videographer takes all reasonable steps to ensure that my suppliers and I hold and process your data securely. This includes ensuring my site and the services named above use SSL and that data is encrypted where possible.

    3. The Videographer keeps up to date with changes in legislation, and will therefore keep this Privacy Policy under regular review.


 

  1. ENTIRE AGREEMENT & SEVERABILITY

    1. This Agreement supersedes any prior discussions or agreements, whether written or oral. If any clause is found unenforceable, it will be severed without affecting the remainder of the Agreement.

  1. GOVERNING LAW AND VENUE

    1. This Agreement is governed by the laws of England and Wales. Any disputes arising from this Agreement will first be attempted to be resolved through mediation. If unsuccessful, they will be submitted to the jurisdiction of the courts of England and Wales.


 

  1. MODIFICATIONS

    1. Any changes to this Agreement must be in writing and mutually agreed upon.

 

  1. CONFIDENTIALITY

    1. Both parties agree to treat all information related to the wedding and this Agreement as confidential unless otherwise agreed in writing.


 

ACKNOWLEDGMENT

Both parties acknowledge that they have read, understand, and agree to the terms and conditions set out in this Agreement.
